PLEASE READ THESE TERMS OF USE (\u201cTERMS OF USE<\/b>\u201d) IN FULL. THIS IS A LEGALLY BINDING CONTRACT BETWEEN YOU (\u201cYOU<\/b>\u201d OR \u201cUSER\u201d) AND HANITA LENSES LTD. (\u201cHANITA\u201d) AND GOVERNS ALL ASPECTS OF USER\u2019S ACCESS TO AND USE OF HANITA\u2019S CALCULATUR AND ANY OTHER APPLICATIONS RELATED THEREOF (THE \u201cAPPLICATION<\/b>\u201d). BY CLICKING \u201cACCEPT\u201d AT THE BOTTOM OF THIS AGREEMENT, YOU AGREE TO ALL TERMS AND CONDITIONS SET FORTH BELOW.<\/p>

  1. General<\/b><\/li><\/ol>

    The Application is provided to physicians for educational and convenience purposes only, in conjunction with the labeling for Hanita\u2019s products. Hanita does not engage in the practice of medicine, and this Application is not a substitute for appropriate medical education and training or for the exercise of independent medical judgment. Hanita cannot warrant the accuracy or completeness of information provided by the Application. Each medical situation should be considered unique to each patient, and all treatments individualized accordingly. Hanita does not endorse or recommend any particular technique beyond what is contained in the product labeling, and other techniques may be appropriate in a physician\u2019s medical judgment.<\/p>

    Any medical procedure has associated complications and risks, and the practice of medicine and standard of care may change over time. Hanita cannot warrant that the information generated by the Application will be error-free, and is not responsible for any deletion or inaccuracy. Hanita expressly disclaims all liability to any person in respect of all matters and all actions taken or not taken based on any information contained herein. Physicians are advised to consult the product labeling, and any appropriate research literature before implementing any new treatments or techniques.<\/p>

    1. License and restrictions on use.<\/b><\/li><\/ol>

      You are hereby granted with a revocable, nontransferable and non sublicenseable license to access the Application and to use it for the limited purpose of performing calculations to help determine the recommended Hanita toric intraocular lens and its suggested axis placement. You may not reproduce or modify the Application without the written consent of Hanita. You agree to use your best efforts to prevent unauthorized use, distribution or publication of the Application.<\/p>

      It is hereby clarified that you do not acquire any ownership right, title or interest in the Application or the content it generates, or in any applicable patents, trademarks, copyrights, trade secrets and other intellectual property rights which may be embodied or contained therein.<\/p>

      1. Proprietary Rights and Licenses<\/b>.<\/li><\/ol>

        Hanita retains all right, title and interest in and to the Application and any derivatives thereof, including any Intellectual Property Rights contained and\/or made available therein or in connection thereto (collectively, the \u201cIP<\/b>\u201c). As used herein, \u201cIntellectual Property Rights<\/b>\u201d means inventions and patents of any type, design rights, utility models or other similar invention rights, copyrights, trademarks, Application marks, trade names, trade dress, logos, trade secret or confidentiality rights, and any other intangible property rights including applications for any of the foregoing, in any country, arising under statutory or common law or by contract and whether or not perfected, now existing or hereafter filed, issued, or acquired.<\/p>

        All use of the IP shall inure to the benefit of Hanita and its licensors, and you shall not reverse engineer, copy, decompile, or disassemble the Application.<\/p>

        Any rights to the Application not expressly granted herein are reserved.<\/p>

        1. Disclaimer.<\/b><\/li><\/ol>

          THE APPLICATION IS PROVIDED ON AN \u201cAS IS\u201d AND \u201cAS AVAILABLE\u201d BASIS. HANITA DOES NOT GUARANTEE THAT THE APPLICATION OR ANY CONTENT PROVIDED VIA THE APPLICATION WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT ANY DEFECTS WILL BE CORRECTED, OR THAT YOUR USE OF THE APPLICATION AND\/OR CONTENT WILL PROVIDE SPECIFIC RESULTS OR BE SECURE. ALL INFORMATION PROVIDED ON THE APPLICATION AND CONTENT IS SUBJECT TO CHANGE WITHOUT NOTICE. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, HANITA DISCLAIMS ALL WARRANTIES, OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF ACCURACY, NON-INFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, COMPLETENESS, AVAILABILITY, SECURITY OR COMPATIBILITY. HANITA DISCLAIMS ANY AND ALL LIABILITY FOR THE ACTS, OMISSIONS AND CONDUCT OF ANY THIRD PARTIES IN CONNECTION WITH OR RELATED TO YOUR USE OF THE APPLICATION AND\/OR THE CONTENT GENERATED BY THE APPLICATION. YOU ASSUME THE TOTAL RESPONSIBILITY FOR YOUR USE OF THE APPLICATION. YOUR SOLE REMEDY AGAINST HANITA FOR ANY REASON WHATSOEVER WITH RESPECT TO THE APPLICATION AND\/OR CONTENT IS TO STOP USING THE APPLICATION OR ANY SUCH CONTENT.<\/p>

          The above disclaimer applies to any and all damages, liability or injuries caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction of or unauthorized access to, alteration of, or use, whether for breach of contract, tort, negligence or any other cause of action.<\/p>

          1. Limitation of Liability.<\/b><\/li><\/ol>

            EXCEPT WHERE PROHIBITED BY LAW, HANITA WILL NOT BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, PUNITIVE, SPECIAL OR OTHER SIMILAR DAMAGES AND ANY LOSS OF PROFITS, LOSS OF REVENUES, LOSS OF SAVINGS, LOSS OF GOODWILL, LOSS OF USE OR LOSS OR CORRUPTION OF DATA, WHETHER UNDER TORT, CONTRACT OR OTHER THEORIES OF RECOVERY, EVEN IF WE WERE OR SHOULD HAVE BEEN AWARE OR ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND IN NO EVENT WILL HANITA\u2019S LIABILITY ARISING OUT OF THE USE OR THE INABILITY TO USE THE APPLICATION, OR ANY OTHER MATTER RELATING TO THE APPLICATION. IF, NOTWITHSTANDING THE OTHER PROVISIONS OF THESE TERMS, HANITA IS FOUND TO BE LIABLE TO YOU FOR ANY DAMAGE OR LOSS WHICH ARISES OUT OF OR IS IN ANY WAY CONNECTED WITH YOUR USE OF APPLICATION, HANITA\u2019S LIABILITY SHALL IN NO EVENT EXCEED US$500.00. THE LIMITATIONS, EXCLUSIONS AND DISCLAIMERS IN THIS SECTION AND ELSEWHERE IN THESE TERMS OF USE APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.<\/p>

            1. Indemnification.<\/b><\/li><\/ol>

              You agree to defend, indemnify and hold harmless Hanita, and its respective officers, directors, employees and agents, licensors, licensees, distributors, agents, representatives and other authorized users, and each of Hanita\u2019s respective affiliates, distributors and suppliers (collectively, the \u201cIndemnified Parties<\/b>\u201c) from and against any and all claims, damages, obligations, losses, liabilities, costs and expenses (including but not limited to attorney\u2019s fees) incurred by the Indemnified Parties in connection with or arising from: (i) your use of the Application and\/or the content thereof; (ii) your violation of these Terms of Use and\/or any additional terms; or (iii) your violation of any third party right, including without limitation any copyright, property, publicity or privacy right. You shall use your best efforts to cooperate with us in the defense of any claim. We reserve the right, at our own expense, to employ separate counsel and assume the exclusive defense and control of any matter otherwise subject to indemnification by you.<\/p>

              1. Termination<\/b>.<\/li><\/ol>

                We may limit, suspend or terminate your account and\/or your ability to access the Application or any content provided on or through the Application, in our sole discretion, immediately and\/or limit, suspend or terminate any future access, with or without cause for your failure to fully comply with these Terms of Use and\/or any applicable additional terms. You agree that we shall not be liable to you or any third-party for any limitation, suspension or termination of your access to or use of the Application or any such content. You also agree that any violation by you of these Terms of Use will cause irreparable harm to Hanita, for which monetary damages would be inadequate, and you consent to Hanita\u2019s seeking any injunctive or equitable relief that we deem necessary or appropriate in such circumstances. These remedies are in addition to any other remedies we may have at law or in equity.<\/p>

                1. General<\/b>.<\/li><\/ol>

                  You agree that any action at law or in equity arising out of or relating to these Terms of Use, and the relationship between you and us shall be governed by and construed in accordance with the substantive laws of the State of Israel without regard to its conflict of law principles. You agree to submit to the personal and exclusive jurisdiction of the courts located in Tel Aviv and waive any jurisdictional, venue, or inconvenient forum objections to such courts. These Terms of Use, together with any additional terms applicable to your use of the Application shall constitute the entire agreement between You and Hanita in connection with or in relation to the Application. If any provision of these Terms of Use is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Use, which shall remain in full force and effect. No waiver of any term of these Terms of Use shall be deemed a further or continuing waiver of such term or any other term, and a party\u2019s failure to assert any right or provision under these Terms of Use shall not constitute a waiver of such right or provision. All provisions of these Terms of Use relating to Hanita\u2019s proprietary rights, disclaimers, and limits of liability or duty, confidentiality, nondisclosure, shall survive expiration or the termination of these Term of Use for any reason.<\/p>

O PRESENTE CONTRATO \u00c9 LEGALMENTE VINCULATIVO ENTRE O USU\u00c1RIO (“USU\u00c1RIO<\/strong>“) E A HANITA LENSES LTD. (“HANITA”) E ADMINISTRA TODOS OS ASPECTOS DE ACESSO E UTILIZA\u00c7\u00c3O PELO USU\u00c1RIO DA CALCULADORA DA HANITA E QUAISQUER OUTROS APLICATIVOS A ELA RELACIONADOS (“APLICATIVOS<\/strong>“). AO CLICAR EM “ACEITAR” NA PARTE INFERIOR DESTE CONTRATO, O USU\u00c1RIO CONCORDA COM TODOS OS TERMOS E CONDI\u00c7\u00d5ES ESTABELECIDOS ABAIXO.<\/p>

                    1. Disposi\u00e7\u00f5es gerais<\/b><\/li><\/ol>

                      O Aplicativo \u00e9 fornecido para m\u00e9dicos somente para fins educacionais e conveni\u00eancia, em conjunto com a identifica\u00e7\u00e3o dos produtos da Hanita. A Hanita n\u00e3o se envolve na pr\u00e1tica de medicina e este Aplicativo n\u00e3o substitui a educa\u00e7\u00e3o e o treinamento m\u00e9dicos adequados nem se aplica a pareceres de m\u00e9dicos independentes. A Hanita n\u00e3o oferece garantias quanto \u00e0 precis\u00e3o ou a integridade das informa\u00e7\u00f5es fornecidas pelo Aplicativo. Cada situa\u00e7\u00e3o m\u00e9dica deve ser considerada exclusiva para cada paciente, assim como todos os tratamentos individualizados. A Hanita n\u00e3o endossa ou recomenda qualquer t\u00e9cnica espec\u00edfica al\u00e9m da contida na identifica\u00e7\u00e3o do produto, e outras t\u00e9cnicas podem ser adequadas a crit\u00e9rio do m\u00e9dico respons\u00e1vel.<\/p>

                      Qualquer procedimento m\u00e9dico tem complica\u00e7\u00f5es e riscos associados e a pr\u00e1tica da medicina e os cuidados padr\u00e3o podem variar com o tempo. A Hanita n\u00e3o oferece garantias de que as informa\u00e7\u00f5es geradas pelo Aplicativo ser\u00e3o isentas de erros e n\u00e3o se responsabiliza por qualquer exclus\u00e3o ou imprecis\u00e3o. A Hanita se isenta expressamente de toda a responsabilidade por qualquer pessoa em rela\u00e7\u00e3o a qualquer assunto ou a\u00e7\u00e3o realizada ou omitida com base em qualquer informa\u00e7\u00e3o contida no presente contrato. Recomenda-se que os m\u00e9dicos consultem a identifica\u00e7\u00e3o do produto e qualquer item de literatura pesquisado e aplic\u00e1vel, antes de dar in\u00edcio a qualquer tratamento ou t\u00e9cnica.<\/p>

                      1. Licen\u00e7a e restri\u00e7\u00f5es \u00e0 utiliza\u00e7\u00e3o.<\/b><\/li><\/ol>

                        Pelo presente, o Usu\u00e1rio far\u00e1 jus a uma licen\u00e7a revog\u00e1vel, intransfer\u00edvel e n\u00e3o sublicenci\u00e1vel para acessar o Aplicativo e para utiliz\u00e1-lo com o objetivo limitado de realizar c\u00e1lculos para ajudar a determinar a lente intraocular t\u00f3rica da Hanita recomendada e o respectivo posicionamento axial sugerido. O Usu\u00e1rio n\u00e3o poder\u00e1 reproduzir ou modificar o Aplicativo sem autoriza\u00e7\u00e3o pr\u00e9via por escrito da Hanita. O Usu\u00e1rio se compromete a se empenhar ao m\u00e1ximo para evitar o uso, distribui\u00e7\u00e3o ou publica\u00e7\u00e3o n\u00e3o autorizados do Aplicativo.<\/p>

                        Pelo presente, fica estabelecido que o Usu\u00e1rio n\u00e3o adquire qualquer direito de propriedade, titularidade ou participa\u00e7\u00e3o sobre o Aplicativo ou o conte\u00fado por ele gerado, ou sobre qualquer patente, marca registrada, direito autoral, segredo comercial ou outros Direitos de Propriedade Intelectual aplic\u00e1veis que possam ser incorporados ou gerados.<\/p>

                        1. Direitos de propriedade e licen\u00e7as<\/b>.<\/li><\/ol>

                          A Hanita det\u00e9m todos os direitos, a titularidade e a propriedade do Aplicativo e sobre ele, bem como quaisquer respectivos derivados, incluindo quaisquer Direitos de Propriedade Intelectual nele contidos e\/ou disponibilizados ou a ele associados (coletivamente, “PI<\/strong>“). Conforme utilizada no presente contrato, a express\u00e3o “Direitos de Propriedade Intelectual<\/strong>” refere-se a inven\u00e7\u00f5es e patentes de qualquer esp\u00e9cie,\u00a0 direitos de projeto, modelos de utilidade ou outros direitos semelhantes sobre inven\u00e7\u00f5es, direitos autorais, marcas registradas, marcas de aplicativos, denomina\u00e7\u00f5es comerciais, identidade visual, logotipos, segredos comerciais ou direitos de confidencialidade, bem como quaisquer outros direitos de propriedade intang\u00edveis, incluindo solicita\u00e7\u00f5es de qualquer dos direitos acima citados, em qualquer pa\u00eds, seja por for\u00e7a de lei ou jurisprud\u00eancia ou contrato, e seja ou n\u00e3o aperfei\u00e7oado, existente ou a ser protocolado, emitido ou adquirido no futuro.<\/p>

                          Todas as formas de utiliza\u00e7\u00e3o de PI devem se reverter em benef\u00edcio da Hanita e de suas licenciadoras e o Usu\u00e1rio se compromete a n\u00e3o realizar engenharia reversa, copiar, descompilar ou desmantelar o Aplicativo.<\/p>

                          Todos os direitos sobre o Aplicativo n\u00e3o expressamente concedidos no presente contrato s\u00e3o reservados.<\/p>

                          1. Termo de isen\u00e7\u00e3o de responsabilidade:<\/b><\/li><\/ol>

                            O APLICATIVO \u00c9 FORNECIDO “NO ESTADO EM QUE SE ENCONTRA” E “CONFORME A DISPONIBILIDADE”. A HANITA N\u00c3O GARANTE QUE O APLICATIVO OU QUALQUER CONTE\u00daDO FORNECIDO UTILIZANDO O APLICATIVO SER\u00c1 ISENTO DE ERROS OU ININTERRUPTO OU QUE QUALQUER FALHA SER\u00c1 CORRIGIDA OU QUE O USO DO APLICATIVO E\/OU DE SEU CONTE\u00daDO PELO USU\u00c1RIO GERE RESULTADOS ESPEC\u00cdFICOS OU SEJA SEGURO. TODAS AS INFORMA\u00c7\u00d5ES FORNECIDAS NO APLICATIVO E NO CONTE\u00daDO EST\u00c3O SUJEITAS A ALTERA\u00c7\u00d5ES SEM AVISO PR\u00c9VIO. AT\u00c9 O GRAU M\u00c1XIMO PERMISS\u00cdVEL PELA LEGISLA\u00c7\u00c3O EM VIGOR, A HANITA SE ISENTA DE TODAS AS GARANTIAS, DE QUALQUER NATUREZA, SEJAM ELAS EXPRESSAS OU IMPL\u00cdCITAS, INCLUINDO E SEM SE LIMITAR A QUALQUER GARANTIA IMPL\u00cdCITA DE PRECIS\u00c3O, N\u00c3O VIOLA\u00c7\u00c3O, COMERCIABILIDADE, ADEQUA\u00c7\u00c3O A UM OBJETIVO ESPEC\u00cdFICO, DISPONIBILIDADE, SEGURAN\u00c7A OU COMPATIBILIDADE. A HANITA SE ISENTA DE TODA E QUALQUER RESPONSABILIDADE POR ATOS, OMISS\u00d5ES E CONDUTA DE QUALQUER TERCEIRO EM RELA\u00c7\u00c3O \u00c0 UTILIZA\u00c7\u00c3O DO APLICATIVO PELO USU\u00c1RIO E\/OU DO CONTE\u00daDO GERADO PELO APLICATIVO. O USU\u00c1RIO ASSUME TOTAL RESPONSABILIDADE PELA SUA UTILIZA\u00c7\u00c3O DO APLICATIVO. A \u00daNICA MEDIDA CORRETIVA CONTRA A HANITA POR QUALQUER MOTIVO QUE SEJA EM RELA\u00c7\u00c3O AO APLICATIVO E\/OU AO CONTE\u00daDO \u00c9 INTERROMPER O USO DO APLICATIVO OU DE QUALQUER CONTE\u00daDO RELACIONADO.<\/p>

                            O termo de isen\u00e7\u00e3o de responsabilidade acima se aplica a todos e quaisquer danos, responsabilidades civis ou les\u00f5es causados por qualquer falha de desempenho, erro, omiss\u00e3o, interrup\u00e7\u00e3o, exclus\u00e3o, v\u00edcio, atraso na opera\u00e7\u00e3o ou transmiss\u00e3o, v\u00edrus de computador, falha nas linhas de comunica\u00e7\u00e3o, roubo, destrui\u00e7\u00e3o, acesso n\u00e3o autorizado, altera\u00e7\u00f5es ou utiliza\u00e7\u00e3o, seja por motivo de quebra de contrato, delito, neglig\u00eancia ou qualquer outra fundamenta\u00e7\u00e3o jur\u00eddica.<\/p>

                            1. Limita\u00e7\u00e3o de responsabilidade civil.<\/b><\/li><\/ol>

                              EXCETO QUANDO PROIBIDO POR LEI, A HANITA N\u00c3O SE RESPONSABILIZA POR QUALQUER TIPO DE DANO CONSEQUENCIAL, EVENTUAL, INDIRETO, COMINAT\u00d3RIO, ESPECIAL OU OUTROS SIMILARES, BEM COMO POR QUALQUER TIPO DE LUCROS CESSANTES, PERDA DE RECEITA, PERDA DE ECONOMIA, PERDA DE BOA-F\u00c9, PERDA DE UTILIZA\u00c7\u00c3O OU PERDA OU CORRUP\u00c7\u00c3O DE DADOS, SEJA POR FOR\u00c7A DE DELITO, CONTRATO OU OUTRAS TEORIAS DE RECUPERA\u00c7\u00c3O, MESMO SE A HANITA TIVER SIDO CIENTIFICADA OU ORIENTADA OU SE HOUVER A OBRIGA\u00c7\u00c3O DE CIENTIFIC\u00c1-LA OU ORIENT\u00c1-LA DA POSSIBILIDADE DESSES DANOS, E EM HIP\u00d3TESE ALGUMA A RESPONSABILIDADE DA HANITA DECORRENTE DA UTILIZA\u00c7\u00c3O OU DA INCAPACIDADE DE UTILIZAR O APLICATIVO OU QUALQUER OUTRO ELEMENTO A ELE RELACIONADO. N\u00c3O OBSTANTES AS DEMAIS DISPOSI\u00c7\u00d5ES DESTES TERMOS, SE A HANITA FOR COMPROVADAMENTE RESPONS\u00c1VEL PERANTE O USU\u00c1RIO POR QUALQUER DANO OU PERDA QUE CAUSADO POR OU DE QUALQUER MANEIRA ASSOCIADO AO USO DO APLICATIVO, A RESPONSABILIDADE DA HANITA EM HIP\u00d3TESE ALGUMA PODER\u00c1 EXCEDER O VALOR DE US$ 500,00.                               1. Indeniza\u00e7\u00e3o.<\/b><\/li><\/ol>

                                O Usu\u00e1rio se compromete a defender, indenizar e isentar a Hanita e seus respectivos dirigentes, diretores, funcion\u00e1rios e agentes, licenciadoras, licenciadas, distribuidores, agentes, representantes e outros usu\u00e1rios autorizados e cada uma das afiliadas, distribuidores e fornecedores da Hanita (coletivamente, “Partes Indenizadas<\/strong>“) de e contra toda e qualquer demanda, danos, obriga\u00e7\u00f5es, perdas, responsabilidades, custas e despesas (incluindo e sem se limitar a honor\u00e1rios advocat\u00edcios) incorridos pelas Partes Indenizadas em decorr\u00eancia de ou associados: (i) ao uso do aplicativo e\/ou do respectivo conte\u00fado pelo Usu\u00e1rio; (ii) a uma viola\u00e7\u00e3o dos presentes Termos de Uso e\/ou de quaisquer termos adicionais por parte do Usu\u00e1rio; ou (iii) a uma viola\u00e7\u00e3o de qualquer direito de terceiros por parte do Usu\u00e1rio, incluindo, entre outros, quaisquer direitos autorais, de propriedade, de publicidade ou de privacidade. O Usu\u00e1rio se compromete a se empenhar ao m\u00e1ximo para cooperar com a Hanita na defesa de qualquer demanda. A Hanita reserva para si o direito de contratar, a suas pr\u00f3prias custas, um advogado pr\u00f3prio e de assumir em car\u00e1ter exclusivo sua pr\u00f3pria defesa, bem como de controlar qualquer mat\u00e9ria que possa estar sujeita a indeniza\u00e7\u00e3o por parte do Usu\u00e1rio.<\/p>

                                1. Rescis\u00e3o<\/b>.<\/li><\/ol>

                                  A Hanita poder\u00e1 limitar, suspender ou rescindir a conta do Usu\u00e1rio e\/ou sua autoriza\u00e7\u00e3o de acesso ao Aplicativo ou a qualquer conte\u00fado fornecido por meio do Aplicativo, a crit\u00e9rio exclusivo da Hanita, imediatamente, e\/ou de limitar, suspender ou rescindir qualquer acesso futuro, com ou sem justificativa, caso o Usu\u00e1rio n\u00e3o mantenha total conformidade aos presentes Termos de Uso e\/ou a quaisquer termos adicionais aplic\u00e1veis. O Usu\u00e1rio concorda que a Hanita n\u00e3o se responsabiliza pelo Usu\u00e1rio ou por qualquer terceiro em rela\u00e7\u00e3o a qualquer limita\u00e7\u00e3o, suspens\u00e3o ou rescis\u00e3o de acesso ou utiliza\u00e7\u00e3o do Aplicativo ou de qualquer conte\u00fado a ele associado. O Usu\u00e1rio concorda outrossim que qualquer viola\u00e7\u00e3o aos presentes Termos de Uso sob sua responsabilidade causar\u00e1 danos irrepar\u00e1veis \u00e0 Hanita, caso em que indeniza\u00e7\u00f5es monet\u00e1rias ser\u00e3o inadequadas, e autoriza a Hanita a pleitear qualquer tipo de medida cautelar ou equitativa que julgar necess\u00e1ria ou adequada sob tais circunst\u00e2ncias. Essas medidas de repara\u00e7\u00e3o s\u00e3o adicionais a qualquer outra repara\u00e7\u00e3o a que a Hanita possa fazer jus nos termos da lei ou por equidade.<\/p>

                                  1. Disposi\u00e7\u00f5es gerais<\/b>.<\/li><\/ol>

                                    O Usu\u00e1rio concorda que qualquer a\u00e7\u00e3o a lei ou ato de equidade relacionados aos presentes Termos de Uso, bem como o relacionamento entre o Usu\u00e1rio e a Hanita, ser\u00e3o regidos e interpretados conforme o direito material do Estado de Israel, n\u00e3o obstante qualquer conflito com outros princ\u00edpios legais. O Usu\u00e1rio se compromete a se submeter em car\u00e1ter pessoal e exclusivo \u00e0 jurisdi\u00e7\u00e3o dos tribunais de Tel Aviv e renuncia a qualquer outro foro ou jurisdi\u00e7\u00e3o e a qualquer obje\u00e7\u00e3o \u00e0 compet\u00eancia desses tribunais. Os presente Termos de Uso, cm conjunto com todos os termos adicionais aplic\u00e1veis ao uso do Aplicativo pelo Usu\u00e1rio constituem o inteiro teor do contrato ora firmado entre o Usu\u00e1rio e a Hanita em rela\u00e7\u00e3o ao Aplicativo. Se qualquer disposi\u00e7\u00e3o dos presentes Termos de Uso for considerada inv\u00e1lida por um tribunal competente, a nulidade da disposi\u00e7\u00e3o invalidade n\u00e3o poder\u00e1 afetar a validade das demais disposi\u00e7\u00f5es dos Termos de Uso, que permanecer\u00e3o integralmente em vigor e efeito. Ren\u00fancias a qualquer disposi\u00e7\u00e3o dos presentes Termos de Uso n\u00e3o poder\u00e3o ser consideradas uma ren\u00fancia subsequente \u00e0s mesmas disposi\u00e7\u00f5es e se qualquer das partes deixar de exigir qualquer direito ou de cumprir qualquer disposi\u00e7\u00e3o dos presentes Termos de Uso, isto n\u00e3o constituir\u00e1 uma ren\u00fancia ao respectivo direito ou \u00e0 disposi\u00e7\u00e3o em quest\u00e3o. Todas as disposi\u00e7\u00f5es dos presentes Termos de Uso relacionadas aos direitos de propriedade, ao termo de isen\u00e7\u00e3o de responsabilidade e aos limites de responsabilidade ou obriga\u00e7\u00f5es, \u00e0 confidencialidade ou ao acordo de sigilo da Hanita, dever\u00e3o subsistir \u00e0 validade ou \u00e0 rescis\u00e3o dos presentes Termos de Uso, qualquer que seja o motivo.<\/p>
